Liens: The Foundation of Secured Lending

When a lender provides capital for a real estate transaction, that capital needs to be secured by something real. In private real estate lending, that security comes in the form of a lien recorded against the property. A lien is a legal claim: if the borrower defaults, the lienholder has the right to pursue the property to recover the outstanding balance.

What Position Means

Multiple liens can exist on the same property simultaneously. Position refers to the order in which lienholders get paid in the event of a forced sale or foreclosure. The first-position lienholder gets paid first, before anyone else. In practice:

Why First Position Is the Standard at Emun Capital

Second-position debt offers higher stated yields precisely because it carries substantially more risk. The yield premium does not adequately compensate most investors for the possibility of a near-total loss in a default and forced sale scenario.

First position with conservative LTV is the combination that makes private real estate lending a genuinely secured asset class.

LTV: The Buffer Between You and Loss

A first-position lien alone does not guarantee recovery, especially when leverage is high or value depends on unfinished work. The appropriate loan amount is deal specific and should be tested against current condition, supported value, realistic repairs, enforcement costs, and time to disposition. After-repair value is an estimate, not cash available today.

What Happens in Default

If a borrower defaults, the first-position lienholder initiates foreclosure. Nevada's non-judicial foreclosure process is relatively efficient. Once the property is sold, proceeds satisfy the first-position lien balance plus accrued interest and fees. Our conservative LTV underwriting is designed so that recovery math works even in a below-ARV sale scenario.
